1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the website at https://attarwala-46200.web.app and any purchase you make from Attarwala Optical House ("we", "us", "our"), a retail optical and fragrance business located at Nagar Palika Complex, Shop No. 1, Opp. Dr. S M Jain Hospital, Dahod, Gujarat 389151, India.

By accessing the website or placing an order, you confirm that you are at least 18 years of age (or have parental/guardian consent), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, please do not use our website or services.

2. Use of the Website

• You may browse and purchase products for personal, non-commercial use only. Resale or commercial exploitation of our products without written consent is prohibited.
• You must not use the website to transmit spam, malware, or any harmful content; attempt to gain unauthorised access to our systems; or scrape our catalogue or pricing data.
• We reserve the right to suspend or terminate access to any user who violates these Terms or engages in fraudulent activity.
• Product images, descriptions, prices, and availability on the website are provided in good faith but may contain errors. We reserve the right to correct errors and update information without prior notice.

3. Products

3.1 Eyewear

Our eyewear range includes prescription frames, sunglasses, and contact lenses. Frames are sold separately from lenses. If you require prescription lenses, the cost of lens fitting is quoted at the time of order based on your prescription, selected lens type (single vision, bifocal, or progressive), and chosen lens tier.

3.2 Prescription Lenses

Prescription lenses are custom-manufactured goods. Once your prescription and lens specifications have been submitted and production has begun, the order cannot be cancelled and lenses cannot be returned or refunded (except where we have made an error).

You are responsible for providing an accurate, valid optical prescription issued by a qualified optometrist or ophthalmologist. We are not liable for vision issues arising from an incorrect prescription provided by you. If you do not have a recent prescription, you may book a free eye test at our Dahod store before ordering.

3.3 Contact Lenses

Contact lenses require a valid contact lens prescription distinct from your spectacle prescription. We supply only sealed, unopened packs from authorised distributors. Opened contact lens packs cannot be returned for hygiene reasons.

3.4 Fragrances

All attars, oud, perfumes, and bakhoor are sourced from trusted artisans and verified suppliers. Fragrances are highly personal products — if you are unsure of a scent, we encourage you to visit our Dahod store to sample before ordering. Opened fragrance products cannot be returned due to their consumable nature.

4. Pricing & Payment

• All prices are displayed in Indian Rupees (₹) and are inclusive of applicable GST unless stated otherwise.
• Prices are subject to change without notice. The price applicable to your order is confirmed at the time of checkout.
• We accept UPI, credit/debit cards (Visa, Mastercard, RuPay), net banking, and Cash on Delivery (COD) where available. COD availability is determined at checkout based on delivery location.
• Payment must be completed in full before your order is dispatched, except for orders placed on COD terms.
• In the event of a payment error or double charge, please contact us immediately and we will investigate and resolve it within 7 business days.

5. Orders & Confirmation

Placing an order constitutes an offer to purchase. Your order is accepted, and a contract formed, when we send you an order confirmation via WhatsApp or email. We reserve the right to refuse or cancel any order at our discretion — for example, if a product is out of stock, if pricing was displayed in error, or if we suspect fraudulent activity. In such cases, any payment already received will be refunded in full.

6. Shipping & Delivery

• We ship pan-India. Estimated delivery times are 5–10 business days for standard orders and may be longer for custom prescription lens orders (7–14 business days).
• Shipping costs, if any, are shown at checkout before payment. In-store pickup from our Dahod location is available at no additional charge.
• All parcels are dispatched with tracking. You will receive a tracking link via WhatsApp or SMS once your order is shipped.
• We are not liable for delays caused by courier partners, natural events, or circumstances beyond our control. However, we will assist you in tracking and resolving any delivery issue.
• Risk of loss and title for products passes to you upon delivery to the shipping address you provided.

7. Returns & Refunds

7.1 Eligible Returns

Unused, unopened products in their original condition and packaging may be returned within 7 days of delivery. To initiate a return, contact us via WhatsApp or email within the return window. We will arrange collection or provide a return address.

7.2 Non-Returnable Items

• Prescription lenses and custom lens orders (made to your specification).
• Opened contact lens packs.
• Opened fragrance products (attars, oud, perfumes, bakhoor).
• Products that have been worn, used, or damaged after delivery.
• Products returned outside the 7-day window.

7.3 Defective or Incorrect Items

If you receive a product that is defective, damaged in transit, or different from what you ordered, contact us within 48 hours of delivery with photos of the issue. We will arrange a replacement or full refund at no cost to you.

7.4 Refund Processing

Approved refunds are processed within 7 business days to your original payment method. UPI and bank transfers may take an additional 3–5 business days to reflect in your account depending on your bank.

8. Warranty

Frames carry a 6-month warranty against manufacturing defects from the date of purchase. This does not cover accidental damage, misuse, normal wear and tear, or damage from improper cleaning. Lenses carry a warranty as specified by the lens manufacturer. Fragrances do not carry a warranty beyond our returns policy. To make a warranty claim, present your order confirmation or proof of purchase.

9. Intellectual Property

All content on this website — including the logo, product photography, descriptions, blog articles, and design — is the property of Attarwala Optical House or its licensors and is protected by applicable Indian copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without written permission.

10. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Attarwala Optical House and its owners, employees, and agents are not liable for indirect, incidental, or consequential damages arising from your use of the website or products purchased. Our total liability in connection with any order is limited to the amount you paid for that order.

Nothing in these Terms limits your statutory rights under the Consumer Protection Act 2019, the Sale of Goods Act 1930, or any other applicable consumer protection legislation.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or your purchase shall first be attempted to be resolved amicably by contacting our customer service. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Dahod, Gujarat, India.

As a consumer, you may also have the right to refer disputes to the relevant Consumer Disputes Redressal Commission under the Consumer Protection Act 2019.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business or applicable law. The effective date at the top of this page will be updated accordingly. Your continued use of the website after any update constitutes acceptance of the revised Terms.
